Section 75(2) of the Family Law Act sets out the principles the court will take into account when finalising the division of assets and liabilities between parties to a former marriage or de facto relationship.

Whilst there is no strict set of rules or 'formula' you can use to understand how the court may divide former matrimonial property, the principles contained within s75(2) are an important guide.

Armstrong Legal Canberra can provide expert advice in relation to this stage of property settlement proceedings.

Matters which may be taken into consideration include the age or health of the parties; their income, property and financial resources; their physical and mental capacity to gain appropriate employment and any responsibilities to care for themselves, young children or other people.

Also relevant will be the standard of living of the person, the effect of any proposed order on the ability of a creditor of a party to recover their debt as well as eligibility for entitlements, such as a pension.

For more information on s75(2) factors in property settlement, contact Armstrong Legal Canberra today.
