The Family Court encourages parties to resolve their property and parenting matters by alternative dispute resolution, where possible. The Family Law Rules 2004 provide that the parties are required to make a genuine effort to resolve their property and parenting matters before an application is made to the Court.

In the case of parenting matters the Court will not accept an application for Orders to be made without the parties first having attended a Family Dispute Resolution Consultant and had that Consultant issue a Section 60I Certificate confirming that Family Dispute Resolution has been attempted. In cases where one party has refused to attend the Family Dispute Resolution, the Family Dispute Resolution Practitioner can issue a Certificate immediately.

There are exceptions to the requirement for Family Dispute Resolution. Application can be made to the Court without such a Certificate if family violence has occurred or the application is urgent.

We can recommend alternate Family Dispute Resolution Practitioners for you to contact in attempt to arrange for your dispute to be mediated. If the mediation of the dispute is unsuccessful you may file your application along with the Certificate obtained from the Family Dispute Resolution Practitioner.
